Obamcare is Unconstitutional & Unsustainable

Not only is Obamacare fiscally unsustainable, it’s unconstitutional according to a U.S. District Court Judge in my old high school stomping grounds around Richmond, Virginia.

I agree with a 2002 Jeopardy champion's take on Obamacare. James Pethokoukis is the Money & Politics columnist for Reuters Breakingviews. Previously, he was the business editor and economics columnist for U.S. News & World Report. Pethokoukis wrote for Reuters yesterday that, "In the end the Supreme Court will determine the constitutionality of Obama’s healthcare reform. If the majority should rule that Americans can’t be forced to buy insurance or face a fine — as the law would require — the entire plan could implode. But whichever way the high court rules, the massive overhaul will itself need an overhaul, if not a complete scrapping, if America is going to get healthcare spending under control and prevent it from bankrupting the U.S. government.

Much of the reform is built around a simple tradeoff. Insurers are required to accept everyone who applies. In return, everyone has to buy a policy. While this means insurers have to accept folks with expensive pre-existing illnesses, they are theoretically compensated with more customers, both sick and healthy. But without the individual mandate, an adverse selection problem emerges — only sick people currently lacking coverage would have an incentive to seek insurance."

In short, the U.S. healthcare system would get even pricier while still leaving vast numbers of Americans without insurance. A more expensive system would mean government healthcare spending would rise even faster.

Even if the White House overturns the Virginia ruling, the system would still require major reform. A detailed review of the law’s fiscal impact by Obama’s own chief healthcare actuary predicts it will save less than originally envisioned. The increase in long-term Medicare hospitalization outlays, for instance, is still scheduled to double to 4 percent of GDP from under 1.7 percent currently.

So even if the law should meet the standard of constitutionality, it fails the standard of sustainability. And there’s no court of appeal for that.

GOP Should Repeal Obamacare

Incoming Republican Majority Leader Eric Cantor has said that Republicans now want to keep two significant parts of Obamacare: forcing insurance companies to offer coverage for people up to age 26 under their parents' policies, and forcing insurance companies to issue coverage for pre-existing conditions.

Libertarian Party (LP) Chair Mark Hinkle commented, "This switch is predictable. Republicans love to say the words 'less government,' but they always vote for more government. It's a shame that the big-government Republican Party succeeded in fooling Americans again on November 2.

Hinkle continued, "Repealing one bill and replacing it with much of the same thing doesn't count as a repeal.

"Issuing coverage for a pre-existing medical condition is like issuing coverage for a house with a pre-existing fire. It doesn't make any sense, and no insurance company would do it in a free market.

"By the same token, forcing insurance companies to cover adults up to age 26 under their parents' policy is absurd. Republicans and Democrats both love to treat adults like children.

"If Republicans succeed in keeping these Obamacare policies, it will mean significantly higher insurance premiums for everyone, in order to subsidize the huge new expenses that insurance companies will be forced to pay."

The LP platform plank on health care states, "We favor restoring and reviving a free market health care system. We recognize the freedom of individuals to determine the level of health insurance they want, the level of health care they want, the care providers they want, the medicines and treatments they will use and all other aspects of their medical care, including end-of-life decisions. People should be free to purchase health insurance across state lines."

ICE/HSI Finds Something to Do

Torrent-Finder.com is down today; the site was apparently seized by government agencies for reasons unknown. In all likelihood, the site was taken down due to intellectual property concerns including copyright infringement and trafficking in counterfeit goods.

The agencies named in the notice include the Department of Justice, the National Intellectual Property Rights Coordination Center, and Homeland Security Investigations (HSI) an arm of (ICE) Immigration and Customs Enforcement.

While torrenting in general is one of the seedier parts of the underbelly of the InternetInternet, Torrent-Finder itself did not host or link to any torrents. Instead, it simply acted as a sort of torrent search engine, returning iframes with other sites that do contain torrents.

Most troubling of all, however, are statements made by the owner of Torrent-Finder.com. He told the bloggers at TorrentFreak that his site was seized “without any previous complaint or notice from any court… While I was contacting GoDaddy I noticed the DNS had changed. Godaddy had no idea what was going on and until now they do not understand the situation, and they say it was totally from ICANN.”

The Obamanation Continues

Shares of Apollo Group (NASDAQ:APOL) traded at a new 52-week low yesterday of $34.20. Approximately 2.3 million shares have traded hands yesterday vs. average 30-day volume of 5 million shares.

Apollo Group closed at $34.37, approximately 19.3% below its 50-day moving average of $42.57. SmarTrend will be monitoring shares of APOL to see if this bearish momentum will continue.

In the last five trading sessions, the 50-day MA has fallen 2.56% while the 200-day MA has slid 1.21%.

In the past 52 weeks, shares of Apollo Group have traded between a low of $34.80 and a high of $66.69 and are now at $34.37, which is 52% of that high price. The stock has fallen 6.2% since the Downtrend alert was issued.

Apollo was a 5 Star rated value stock by Morningstar and a strong analyst BUY at the beginning of the year.  Then Obama went to war against "for-profit" education.  Obama's actions speak louder than his teleprompter. Obama despises capitalism because he is a pro Marxist Statist. 

We reap what we sow. Electing a Marxist to the Office of President of the United States will always yield a crop of tyranny and financial disaster for the American people to consume.

Urge Jindal to seek GOP Nomination

Bobby Jindal , the Governor of Louisiana, has claimed that he is not interested in running for president in 2012.  I hope he changes his mind. I believe that Jindal would is the BEST nominee for the GOP.  The more Americans get to know him, the more pressure there will be for him to seek the nomination.

Jindal supports a MUCH smaller federal government and is a strict Constitutionalist. 
Louisiana Governor Bobby Jindal’s new book, “Leadership and Crisis,” highlights the Obama administration’s failure to consider the unintended consequences of its policies. I plan on reading the new book and will be posting about it.

Jindal, a rising star selected by the GOP to give the party's response to US President Barack Obama's February 2009 address to Congress , has said that the only race he is interested in is the one to keep his own job.

"I'm not being coy at all. I'm not running for president in 2012. Period. No ifs, ands or buts, no caveats. We have made great progress in Louisiana, but we've got a lot more work to do," Politico quoted Jindal, as saying.

Jindal has been touring the country promoting his book "Leadership and Crisis," in which he focuses on Republican policy and talks about what he called a "lackadaisical" response from the Obama administration to the Gulf oil spill.

According to Jindal, on Obama's first trip to Louisiana after the disaster, the President took him aside on the tarmac after arriving to complain about a letter that he had sent to the administration requesting authorization for food stamps for those who had lost their jobs because of the spill, the report said.

As Jindal describes it in his book, the letter was entirely routine, yet Obama was angry and concerned about looking bad.

"Careful," he quotes Obama as warning him, "this is going to get bad for everyone."

After losing his first bid for the governorship in 2003 and then serving two terms in Congress, Jindal has enjoyed wide popularity since winning the governor's mansion in his native Baton Rouge in 2007.

Don't Tread on Me


Early voting ends tomorrow. I voted last week and for the first time in my life I checked one box: 

STRAIGHT REPUBLICAN TICKET.  I have voted Libertarian Party in all National Elections for over twenty years, never voting for a Clinton or a Bush.  But I can't waste a vote on the Libertarian Party this year. Our country is in a crisis unlike any other in my lifetime.  The Tea Party movement is moving the GOP in the right direction.

LP has failed because both the GOP & DemocRATS have successfully prevented a third party from becoming viable in the USA. The Tea Party has taken off because the GOP decided to adopt their agenda to save themselves. Sad but true. The Libertarian Party is for all practical purposes non-existent.  The only success the Libertarian Party has enjoyed in the last 40 years is the birth of the Tea Party movement.

Politics is a dirty, nasty  business. It always has been and always will be. Politicians are scum. Term limits are the only cure for the disease of political corruption. I will continue to pay my nominal annual membership fee to the Libertarian Party but I have stopped my monthly contributions. Instead I am contributing directly to Libertarian principled candidates like Sharon Angle of Nevada.

We must be realistic.  The country is not going to embrace all of the Libertarian principles that I believe our country needs to be the greatest nation on earth.  But the Tea Party is a viable alternate and a step in the right direction. We are stuck with an impenetrable  two party system. I am convinced now that we must work within the two party system to save our country from the Socialist/Communist Party aka DemocRATS.

One of the reasons the GOP will take over the House, is that the far left wing-nuts of the DemocRAT party are not going to vote next Tuesday.  I am not going to make the same mistake.  I will work within the Republican Party, via the Tea Party movement because it's my only realistic option for stopping the Obamanation of America at this time.

I encourage you to do the same.  We MUST stop the bleeding NOW.  The GOP is our only realistic ballot box option for saving the country from Euro Socialism or worse.

Left wing DemocRATs are the most viscous, mean spirited, totalitarians in the country. PERIOD.

MSNBC (Marxist Socialist National Broadcasting Network) hires hosts who insult, demonize and vilify any and all opponents of their progressive agenda. MSNBC believes that freedom of speech, assembly and press applies only to supporters of their liberal fascist agenda.

Keith Olberman, Rachel Maddow and THE Ed are liberal fascists who spend most of their broadcast time bashing the"forces of evil", who they define as Tea Party supporters and FOX News employees.

You never hear or read about conservatives, libertarians, or Tea Party supporters advocating the government shut down MSNBC or CNN. Yet MSNBC and their libtard, left wing nut job viewers are obsessed with shutting down FOX.

Liberals don't care about the Constitution or anything else that they perceive as interfering with their Progressive socialist agenda. Wake up America. We can non longer stand idly by why far left radicals hijack the Republic. THE BALLOT IS YOUR BEST WEAPON in the fight for freedom. Get out the vote on November 2, to get out the totalitarian hijackers of liberty.

DemocRATS Never Cease to Amaze Me

As you know, I'm a Libertarian not a Republican. Libertarians were on the right side of the Constitution decades before the Tea Party, which sprang up as a result of the Obamanation of America.  Here's the latest DemocRAT ploy to go against the will of the people as reported in today's Wall Street Journal. 

The Supreme Court begins its new term this morning, amid front-page media lamentations that the Justices have become too partisan under Chief Justice John Roberts. This is best understood as not-very-subtle lobbying of Justice Anthony Kennedy, the most frequent swing vote on what has been a largely centrist Court. But never fear, Pat Leahy has an idea to create a liberal majority anyway—at least on some cases.

The Senate Judiciary Chairman wants Congress to pass a law allowing retired Justices to pinch-hit on cases in which one of the current Justices is recused. His timing is no accident. New Justice Elena Kagan is expected to recuse herself from some 25 cases that she was involved with as Solicitor General, which would mean one fewer vote for the court's liberal bloc.

Conveniently for Mr. Leahy, of the recently retired Justices, the three available Supreme Court subs would be John Paul Stevens, David Souter and Sandra Day O'Connor. Justices Stevens and Souter were reliable liberal votes, while Justice O'Connor was once the Court's swing vote, tilting left in her later years on many issues, especially racial quotas and free speech restrictions.

As for the perception of a partisan Court, President Obama has done more to promote that idea than anyone else now in politics. In his recent Rolling Stone interview, Mr. Obama once again trashed "the Roberts Court" by name for its campaign-finance ruling last year. We hope the Court ignores this attempt at political intimidation and that Congress takes a pass on Mr. Leahy's half-baked plan to pack the bench.



Liberals Crash Tea Party, But Stay Silent On Black Panther Hate Talk

Over the past year, members of the liberal media, progressive politicians and the Hollywood elite have demonized the tea party movement partly by claiming that tea partiers are a fringe group driven by racial animosity.

Now, faced with unequivocally racist antics by members of the New Black Panther Party, the progressive establishment seems devoid of passion to root out hatred.

This apparently selective outrage exposes what’s seemingly propelling progressives. Politics rather than morality appears to be the motivation behind the progressive crusade against Tea Party reformers.

Slandering tea party activists is apparently a politically expedient necessity because they pack the punch to change the political landscape and knock down President Obama’s progressive agenda. 

Dealing the race card has always been a central element of the progressive strategy. By claiming that tea party opposition to President Obama’s agenda is motivated by anger over a black president, progressives hope to transform the debate from one about policy to race, thus marginalizing the tea party’s effectiveness.

MSNBC host Keith Olbermann, for instance, said tea partiers are “a bunch of guys who are just looking for a reason to yell at the black president.” During the Obamacare debate, Representative Charles Rangel (D-NY) claimed that “bias” and “prejudice” against President Obama are the reasons why there was so much opposition to his health care proposal. 

Helping spread the lie that tea parties are a solely white affair, Rangel added: “You don’t see any black folks in these groups. Ever, ever, ever, ever, ever.” Representative Steve Cohen (D-Tenn.) piled on, saying tea party rally participants “are kind of without robes and hoods” and are “against any type of diversity.”

Janeane Garofalo, a left-wing activist and some-time actress, called tea partiers “rednecks” and claimed, “It’s about hating a black man in the White House.”

These Herculean efforts on the part of the progressive media-politician-Hollywood complex to slime the tea parties, however, are long on claims and short on proof. As a result, the race card failed to tarnish the image or effectiveness of tea party activism.

Tea party-backed candidates are winning primaries, and polls find that the movement enjoys broad-based support. A recent New York Times/CBS News poll found tea party supporters tended to be “wealthier and more well-educated than the general public” and “married and over 45.” 

And it doesn’t help when progressives turn a blind eye to radicalism in their own ranks. When confronted with videotaped evidence of the morally abhorrent behavior by members of the New Black Panther Party, progressives are noticeably silent.

Videos vividly show New Black Panthers’ political and racial extremism. One video, taken at a polling station in Philadelphia on Election Day 2008 clearly shows Panther activists dressed in paramilitary uniforms and one carrying a menacing nightstick. This led to a U.S. Department of Justice investigation of voter harassment.

Another video, taken for a National Geographic documentary, shows the nightstick-wielding Panther from Election Day delivering a hateful racial rant targeting whites — specifically white children — for murder.

Besides video evidence, the New Black Panther Party’s political platform found on its website radically calls for reparations for slavery because “this wicked racist government has robbed us.” It conspiratorially demands an “end to the trafficking of drugs and to the biological and chemical warfare targeted at our people.” Furthermore, they say “as our political objective, we want NATIONAL LIBERATION in a separate state or territory of our own.”

In contrast, the mission and goals of the tea party movement — as expressed by the Contract from America — peacefully defines broad-based principals of limited government and free enterprise and a ten-point policy agenda for Congress. 

But, despite their morally reprehensible behavior, criticizing the New Black Panther Party seems to yield few political points for progressives. Even allegedly blocking people from voting seems to not ruffle progressive feathers, as the Obama Justice Department dismissed the voting rights case against the Panthers for allegedly political reasons.

It’s long past time for someone on the left to rise above the political fray and make a strong statement against black hate speech. It’s time to view this as a matter of right or wrong, not left or right.
